Terms of Service

These terms and conditions ("Terms") apply to all users of the Tooused platform, including Consumers, Retailers, and Recyclers. By accessing or using our platform, you agree to these Terms in full. If you disagree with these Terms or any part of them, you must not use our platform.

1. Definitions

  • Consumer: An individual user who submits their used clothes to Tooused.
  • Retailer: A business entity or individual who purchases used clothing items from Tooused for resale purposes.
  • Recycler: A business entity or individual who procures used clothing items from Tooused for recycling or repurposing.

2. User Obligations

  • Consumers must ensure that the clothes they submit are in decent condition, free from contaminants or hazardous materials.
  • Retailers are obligated to maintain ethical resale practices, including transparent pricing and appropriate representation of procured items.
  • Recyclers must adhere to environmental and safety guidelines in the recycling and repurposing of procured items.

3. Intellectual Property

  • All content on the Tooused platform, including but not limited to text, graphics, logos, and images, are the property of Tooused. Unauthorized use, reproduction, or redistribution of this content is strictly prohibited.

4. Pricing, Payments and Payouts

  • Retailers and Recyclers: Prices for items procured from Tooused will be set by Tooused. Payments are to be made via the methods specified on the platform.
  • Consumers: Will be eligible for a payout post reaching a minimum threshold limit of INR 50. For each cashout request, a Platform fee/Convenience fee of 15% and 18% GST on the Platform/Convenience fee will be charged. It's consumer's responsibility to provide correct UPI details for the payout.

5. Returns and Refunds

  • Retailers: Items purchased from Tooused are final sale. Returns or refunds are not accepted unless the item is found to be misrepresented.
  • Recyclers: Given the nature of the items, no returns or refunds are permitted.
  • Consumers: At Tooused, we are committed to providing a seamless and efficient process for helping our customers declutter their wardrobes by purchasing their used clothes.
      • No Returns Policy
    • Once Tooused has collected and received the clothing items, they cannot be returned to the customer under any circumstances.
    • By selling and sending your used clothes to Tooused, you acknowledge that ownership of the items is transferred to Tooused at the point of collection or drop-off, and no further claims or requests for returns will be entertained.
      • Payment in Tooused Credits
    • Tooused credits customers with Tooused credits (1 Tooused credit = 1 INR) based on the value of the items as displayed in the Tooused app at the time of listing.
    • The value of each item is clearly visible in the app before the customer submits them for collection, ensuring transparency on pricing.
      • No Refund
    • Tooused offers a clear and final value for each collection of used clothes based on factors such as the quality, condition, and type of garments. Once payment has been made, no refunds or adjustments will be provided.
    • The assessment of the value is done prior to finalizing the purchase, and all payments made to you as a seller are deemed full and final.
    • As the price of each item is pre-determined and visible in the app, no disputes regarding the valuation of items will be entertained after the clothes have been submitted.
    • Post pickup of your order, and verification of the clothes at our facility, Tooused holds the right to deduct the offered credits for the clothes in bad condition/non-wearable condition, shown while scheduling the pickup.
    • Post verification of the clothes at our facility, Tooused also holds the right to reduce the offered credits for the clothes if their market price is changed or the demand becomes less among our Retailers and Recyclers.
      • Approval and Credit Issuance
    • After the clothes are received at our warehouse, Tooused will evaluate and approve the items. Once approved, the corresponding Tooused credit will be credited to the Consumer’s Tooused wallet.
    • These Tooused credits can then be converted to cash or used to purchase coupons and vouchers through our platform.
      • Final Sale Terms
    • Tooused operates on a final sale basis for all transactions. As part of our eco-friendly and sustainable practice, once the clothes leave your possession, they are processed for reuse, recycling, or donation. This policy ensures efficient handling and minimizes environmental impact.
      • Consumer Responsibility
    • It is the consumer's responsibility to ensure that they only send clothes they are certain they wish to sell. By engaging with Tooused, you agree that you have voluntarily transferred ownership of the items, and they cannot be reclaimed once the transaction is complete.
    • Consumer's are responsible for reviewing the price of each item before submitting clothes to Tooused. By confirming the listing and proceeding with the sale, you agree that the transaction is final.

6. Termination

  • Tooused reserves the right to terminate or suspend access to our platform for users who violate these Terms.

7. Disclaimers

  • Consumers: While Tooused makes every effort to ensure your clothes find a new home or purpose, we do not guarantee purchase or recycling of every item.
  • Retailers: Tooused makes efforts to ensure the quality and authenticity of items, but does not guarantee the longevity or origin of individual items.
  • Recyclers: Tooused is not responsible for any contaminants or hazards in the clothes not detected during our initial inspection.

8. Liability

  • Tooused shall not be liable for any indirect, special, incidental, consequential, or exemplary damages arising from your use of the platform or any third party's use of the platform.

9. Changes to These Terms

  • Tooused reserves the right to update or change these Terms at any time, and you should check this page periodically. Your continued use of the service after we post any modifications will constitute your acknowledgment of the modifications and your consent to abide by the modified Terms.

10. Governing Law

  • These Terms shall be governed by and construed in accordance with the laws of India.
